Taking The Husband's Name After Marriage – Not
Based on Shareeah
In our eagerness to copy the West, we Muslims have adopted many of their practices which have no basis in the Sharee'ah. And among them is the practice of a woman changing her family name to that of her husband after she gets married.
The fact is that Islam does not require woman to change her name at marriage and there is nothing in the Sunnah to indicate that a woman should take her husband's name after she gets married.
Actually, the Ulama tell us that this is an innovated practice that is not approved of in Islaam.
Now, I know some people will say…" Oh, come on…What is the big deal?!!"
So read on and you will know what I mean….
The wives of the Prophet (Sal Allaahu Alaiyhi wa Sallam) are the Mothers of the Believers, and the Prophet (Sal Allaahu Alaiyhi wa Sallam), is the noblest of people and the best example. And yet when we look at their example, we will realize that when the Prophet(Sal Allaahu Alaiyhi wa Sallam) married any of his wives, NOT ONE of them took his name. On the contrary, each one of them kept her father's name even if her father was a kaafir. Similarly, the wives of the Sahaabah and those who came after them did not change their names.
Did you ever think why they didn't do that?
Surely, if it was a good thing, the wives of the Prophet(Sal Allaahu Alaiyhi wa Sallam) would have done it and the Prophet(Sal Allaahu Alaiyhi wa Sallam) would himself have instructed it and encouraged them to do it.
That is because it is Allaah's order to keep your father's name as an indication of your lineage.
"Call them (adopted sons) by (the names of) their fathers, that is more just with Allaah…" [al-Ahzaab 33:5].
And the Prophet (Sal Allaahu Alaiyhi wa Sallam) said: "Whoever calls himself by other than his father's name, will be cursed by Allaah, the angels and all the people." (Ibn Maajah -Saheeh by al-Albaani).
And he (Sal Allaahu Alaiyhi wa Sallam) also said:
"Whoever knowingly claims to belong to anyone other than his father, Paradise will be denied him." (Ahmad, al-Bukhaari, Muslim).
Now some might argue…."But the woman is not claiming that her father is someone else. She is just honoring her husband or she doesn't mean it that way. She just wants to belong to her husband out of love for him."
To those people I say….
If it was a matter of honor to have the husbands name attached to the wife's, wouldn't our Ummahaat have done that??
Isn't it the biggest honor in the WORLD to have the name of the Prophet(Sal Allaahu Alaiyhi wa Sallam) attached to yours?? And yet the wives of the Prophet(Sal Allaahu Alaiyhi wa Sallam) didn't do that.
Ever wonder why??
And if it was a matter of expressing love for the husband, no relationship between a husband and wife on the face of this earth was better than the relationship between the Prophet(Sal Allaahu Alaiyhi wa Sallam) and his wives. And yet none of the Mothers of the Believers expressed their love for the Prophet (Sal Allaahu Alaiyhi wa Sallam) by changing their last names.
It doesn't make any sense
The last name is an indication of the father of the person and represents the person's lineage.
Shaykh Bakr Abu Zayd said: "This is one of the beauties of Sharee'ah, because calling a person by his father's name is more appropriate for knowing who is who and telling people apart….." (Tasmiyat al-Mawlood, 30, 31).
Originally, the woman is 'the Daughter of So and so', and NOT 'the wife of So and so'. Since there is no blood relationship between the husband and wife, how can she take his last name as if she is part of the same lineage?
And surely, she is not claiming that he is her father!!!!
Also what happens if she gets divorced, or her husband dies, and she marries another man? Will she keep changing her surname every time she marries another man?
In addition to this, there are rulings attached to the woman being named after her father, which have to do with her inheritance, spending and who is her mahram, etc. Taking her husband's last name overlooks all that.
Also, if you think about it, the husband is named after his own father, and what does she have to do with the lineage of her husband's father? This goes against common sense and true facts.
Besides, the husband has nothing that makes him better than his wife's father. So why should she give up her father's name and take her husband's last name??
And why does the man get to keep his father's name and not the woman??!!
It just doesn't make any sense.
Sheikh Salih Al-Munajjid says:
"A woman changing her family name to that of her husband after she gets married is Haraam and is not allowed in Sharee'ah, because it is not permissible for anyone to claim to belong to anyone other than his or her father…… And Allaah knows best."
Not only is it so in this world, but, we will also be called by our father's name in the Hereafter as well. The Prophet (Sal Allaahu Alaiyhi wa Sallam) said:
"On the Day of Resurrection, each betrayer will have a banner raised beside him, and it will be said, this is the betrayer of So and so, the son of So and so." (Bukhaari, Muslim).
So, all you single females out there, don't be in such a hurry to change your maiden name after you get married. And those of you who have already done that, it is never too late. Take back your maiden name and reclaim your identity. It is part of the Sharee'ah.

Ali Ibn Abi talib Ra said
"The Messenger of Allah had forbidden Mutah on the day of Khaybar and had forbidden the eating of the meat of domestic camels." [Bukhari, Muslim, Tirmizy, Ibn Majah, Nasa`i, Tahawy, Shafi'i, Bayhaqy, and Hazimy]
Ali said to a man who was engaging in Muta
"You are a straying person, the Messenger of Allah has forbidden temporary marriage and the meat of domestic camels on the day of Khaybar." [Muslim and Bayhaqy
When Al was given the Caliphate, he thanked Allah Most High and praised Him and said:
"O people, the Messenger of Allah had permitted Mutah three times then forbade it. I swear by Allah, ready to fulfil my oath, that if I find any person who engages in temporary marriage without having ratified this with a proper marriage, I will have him lashed 100 stripes unless he can bring two witnesses to prove that the Messenger had permitted it after forbidding it." [Ibn Majah
Now from Shia Scholars
Abdullah Bin Umair asked Abi Ja'far [as]: Is it acceptable to you that your women, daughters, sisters, daughters of your aunties do it (Mut'ah)? Abu Ja'far rebuked him when he mentioned his women and daughters of his aunties.Imam Baqir (as), recorded 'Tahdeeb al Ahkam' and 'Furu al Kafi':Pp476.V2/Pp34.V5
Ja'far Al-Sadiq says in a narration by Abdallah bin Sinan: "I asked Abu Abdullah (as) about Mutah. He said: "Don't defile yourself with it" Bihaar Al-Anwar, Volume 100, page 318 By AL Majlisi.Classfied as Hasan[With Good Chain of Narration] by him and sheikh Safar AL Shafi Saheeh[Authentic] in his AL Shafi,Pp61.V8.
so we see here how mutah is forbidden in shia ism let alone sunnah, yet these imams who make haram halal claim it is permissible and halal.
A woman who lets a man do Mutah with her will have all her sins pardoned. It is narrated by Imam Baqir that the Prophet said, "When I was being taken to Heaven during the Miraj (ascension), Jibraeel met me and told me, 'O Muhammad, Allah has promise to forgive all the sins of those women who practise Mutah.'"
و بهذا الإسناد عن أحمد بن علي كذا عن الباقر (عليه السلام) قال : قال رسول الله (صلّى الله عليه وآله وسلّم) لما أسري بي إلى السماء لحقني جبرئيل فقال يا محمد إن الله عز و جل يقول إني قد غفرت للمتمتعين من النساء
Now not once but twice their hadith days if a woman does Mutah twice Allah will forgive her sins, can you beleive it , if a woman does zina twice Allah will forgive her
Jibraeel told me, "Ya Muhammad, Allah said: 'I will forgive a woman from your Ummah who has engaged in Mutah twice.'" ("Mugni", Ali ibn Husayn ibn Babaveyh Al Qummi.
Can you beleive it. hadith is clear above from Ali ibn abi talib of the prohibition, yet their shaitan imam make it halal for the poor woman rather than her repenting she should do it twice to get forgiven
They claim it is part of the sunnah to do mutah, not the sunnah of the prophet saws For sure but their shaitan sunnah.
It is blame-worthy to avoid doing Mutah because it is part of the Sunnah to engage in Mutah."
و بالإسناد عن ابن عيسى عن ابن الحجاج عن العلاء عن محمد بن مسلم عن أبي عبد الله (عليه السلام) أنه قال لي : تمتعت قلت لا قال لا تخرج من الدنيا حتى تحيي السنة
A man may have Mutah with one thousand women."
و عن أبي بصير أنه ذكر للصادق (عليه السلام) : المتعة هل هي من الأربع فقال تزوج منهن ألفا
Not one not two and then repent a thousand can you beleive these people
Aoothubillah min shia
Punishment for Not Performing Mutah:
The people who do Mutah are blessed but those who avoid Mutah are cursed until the Day of Judgement."
و بهذا الإسناد عن أحمد بن محمد عن موسى بن علي بن محمد الهمداني عن رجل سماه عن أبي عبد الله (عليه السلام) قال : ما من رجل تمتع ثم اغتسل إلا خلق الله من كل قطرة تقطر منه سبعين ملكا يستغفرون له إلى يوم القيامة و يلعنون متجنبها إلى أن تقوم الساعة و هذا قليل من كثير في هذا المعنى
So we see where the truth lies now for the icing on the cake

Q: Amongst the young generation it is almost IMPOSSIBLE now to find a girl for mut'aa to gratify sexual needs in the West and also in the East. Can't we be allowed to do mut'aa with prostitutes for sexual pleasure?
A: It is permissible to marry a prostitute temporarily provided that she understands that it is a religious contract for marriage and not a fee for adultery.
Q: Is it permissible to have mutaa - temperary marriage - with a woman who commits adultery with men?
Is it permissible to have mutaa with a woman who probably commits prostitution and adultery as a job?
A: Yes, it is allowed in both cases.
In Islam if the woman is misguided we invite her back to islam we do amr bin maruf wa nahi anil munkhar , stop her from prostituting herself. She do mutah with her make it even worst for her. according to them if a woman does mutah Allah forgives her sins so a prostitutes just does mutah and she is forgiven

اللہ کے پیارے نبی محمد مصطفی خیر الانبیاء ﷺ فرماتے ھیں کہ میرا جی چاھتا ھے کہ نماز میں لمبی قرات کروں مگر کسی خاتون کا بچہ رو پڑتا ھے اور میں سوچتا ھوں کہ اس کی ماں کا دل بچے میں اٹک گیا ھو گا،میں اس کی سہولت کے لئے قرات کو مختصر کر دیتا ھوں،،
کیا بات ھے ھمارے نبیﷺ کی دلجوئی کی کہ نماز میں بھی لوگوں کے احساسات پر نظر ھے، اپنے اعمال سے ویسے لگتا نہیں کہ ھم ان کے امتی ھیں ! اولاد کو والدین کے احساسات کا خیال نہیں تو والدین کو اولاد کے دل کی خبر نہیں حالانکہ وہ اولاد رہ کر آئے ھیں،، والدین کو پتہ ھے اور تجربہ ھے کہ والدین کی کون سی بات گولی کی طرح لگتی ھے ۔۔ مگر پھر بھی وہ یہ گولی اولاد کو مارے بغیر رھتے نہیں کیونکہ یہ گولی بزرگوں کی امانت ھے آگے پہنچانا ضروری ھے ،، شوھر کو یہ احساس نہیں کہ اس کی اک ذرا سی بات،بس اک چھوٹا سا جملہ ان کی پارٹنر کی رات کی نیند اڑا دیتا ھے،، وہ مر مر کے جیتی اور جی جی کے مرتی ھے ،، ھر روز کی یہ ٹینشن اسے ڈیپریشن کا مریض بنا دیتی ھے،اور پھر اس کا ٹائی راڈ ٹوٹ جاتا ھے،،نارمل آدمی جب بولتا ھے تو پتہ چل جاتا ھے اگرچہ غصے میں بولے اور ابنارمل آدمی بھی جب بولتا ھے تو پتہ چل جاتا ھے،،جب بیوی ڈیپریشن میں بولنا شروع کرے تو انسان کو محسوس ھو جانا چاھئے کہ یہ اب اپنے آپ میں نہیں ھے اور مرفوع القلم پوزیشن میں ھے ! لہذا چپ کر کے سنتے رھنا چاھئے،، باھر بھی نہیں بھاگ جانا چاھئے ورنہ مواد عورت کے اندر ھی رھے گا،اب جو پھوڑا پھٹ گیا ھے اس کا پورا مواد نکل جانے دیں ! یہ آپ کی عطا تھی اسے آپ ھی وصول کیجئے ،خط جب واپس آتا ھے تو اسی ایڈریس پر واپس آتا ھے جہاں سے بھیجا جاتا ھے !
خواتین کا معاملہ بھی کچھ ملتا جُلتا ھے،، کام پر جاتے شوھر کی پیٹھ پر ایسا انگارہ رکھ دیں گی پہلے تو کام پر جاتے ھوئے رستے میں وہ گاڑی کو جہاز سمجھ کر چلائے گا اور ایکسیلیریٹر کو بیوی کا گلا سمجھ کر دبائے گا اور سارا دن ڈیوٹی پر افسروں سے اور دفتر کے ساتھیوں سے منہ ماری کر کے انگارے کی تپش کم کرتا رھے گا،مگر وہ کم ھوتی نہیں ھے،،کیونکہ جس نے رکھا ھے خوب ناپ تول کر رکھا ھے،، سوتے وقت کوئی ایسی بات کر دیں گی کہ ساری رات بستر انگاروں کا بستر بنا رھے گا،،اب جب صبح یہ بندہ ڈیوٹی پہ جائے گا تو نیند کا مارا ھر ایک کے گلے پڑے گا ،، عین کھانا کھاتے ھوئے خود کش حملہ کر دیتی ھیں اور کھانا زھر بنا دیتی ھیں،، مناسب وقت پر غیر معقول بات بھی قابلِ برداشت ھوتی ھے،مگر ڈیوٹی ٹائم،، سوتے وقت اور کھانا کھاتے وقت کسی قسم کی اختلافی گفتگو نہیں کرنی چاھئے !
خیر بات کہاں کی کہاں نکل گئ ھے ! عرض کرنا چاہ رھا تھا کہ ھمیں جو بات بطور مقتدی ،اپنے امام سے پسند نہ آئی کوشش کی کہ امامت کے وقت میرے مقتدیوں کو اس صورتحال کا سامنا نہ کرنا پڑے،، جب ھم ڈیوٹی پہ جایا کرتے تھے تو فجر کی نماز میں ادھر بس کا ٹائم ھو جاتا،، ادھر مولوی صاحب کا ذوق وجد میں آ جاتا ،، اب ھم پر ایک ایک لمحہ بھاری ھے ،بس نکل گئ تو 35 درھم کی ٹیکسی بک کر کے جانا پڑے گا،، کئ دفعہ ایسا ھوا کہ نماز توڑ کر نکل جانا پڑا اور کام پر جا کر نماز پڑھی،کئی دفعہ نیت کی کہ اگر آج بس نکل گئ تو ٹیکسی کا کرایہ مولوی صاحب سے لیں گے ،، تو عالیجاہ اپنی تو عادت بن گئ ھے کہ چھوٹی چھوٹی سورتوں سے فجر پڑھاتے ھیں، مختصر تسبیحات پڑھتے ھیں تا کہ کسی کی بس نہ نکل جائے،،!
پہلے نماز میں بچے رویا کرتے تھے اب موبائیل روتے ھیں،، اگر بس ڈرائیور ھے تو سواریاں کال کرنا شروع کر دیتی ھیں کہ کہیں سویا نہ رہ گیا ھو ،،سواری ھے تو ڈرائیور کال مارتا ھے،" کہاں مر گئے ھو "؟ بس اپنا حال تو شاعر جیسا ھے جس نے عرض کیا تھا !
اسی کشمکش میں گزریں میری زندگی کی راتیں !
کبھـی ســوز و ســـازِ رومی ،کبھی پیچ و تابِ رازی !
عرصہ تیس سال سے زائد ھوا ھے کہ ھمارے پڑوسی مسکین مرحوم نے پاکستان میں نماز کے بعد ھم سے مسئلہ پوچھا تھا کہ " قاری صاحب اگر ایک آدمی دمے کا مریض ھے اور اس کی سانس سجدے میں رک جاتی ھے تو کیا وہ سر سجدے سے اٹھا کر سانس لے کر دوبارہ مولوی صاحب کے ساتھ سجدے میں شامل ھو سکتا ھے ؟ چونکہ مسکین مرحوم شدید دمے کا مریض تھا،، بھائیو وہ دن اور آج کا دن میں نے کبھی 3 بار سے زیادہ سجدے کی تسبیح نہیں پڑھی،مجھے اپنے پیچھے کئی مسکین نظر آتے ھیں،، میرے بہت اچھے دوست وجاھت ھاشمی صاحب نے رمضان میں تراویح کے بعد کہا کہ قاری صاحب، باقی اماموں کے پیچھے ھم نماز پڑھتے ھیں تو تسبیحات کا دورانیہ بدلتا رھتا ھے،،کبھی تو یوں لگتا ھے مولوی صاحب سو ھی گئے ھیں،،مگر آپ کے پیچھے مدت سے جمعہ اور تراویح پڑھی ھے،ایسا نپا تلا پیمانہ ھے کہ ادھر تین پوری ھوئیں ادھر اللہ اکبر،، میں نے کہا مسکین مرحوم خود تو فوت ھوگیا ھے،مگر میری سپیڈ باندھ گیا ھے !قاری حنیف ڈار
